These Terms of Service (“Terms”) govern your access to and use of goodiesforbio.store (the “Site”) and any purchase you make from Goodies for Bio Co. (“Goodies for Bio”, “we”, “us”, “our”). Please read them carefully. By browsing the Site, creating an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree with them, please do not use the Site.
1. Who we are
Goodies for Bio Co. is a retailer of pet treats, toys, bowls, bedding, grooming equipment and everyday pet supplies, operating from 2140 Springdale Rd, Suite 8, Cherry Hill, NJ 08003, United States. You can reach us at orders@goodiesforbio.store, Monday to Friday, 9am to 5pm Eastern Time, excluding public holidays. References in these Terms to “you” mean the person browsing the Site or placing an order.
2. Eligibility and account use
You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use belongs to you or that you have express authority to use it.
If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please tell us promptly if you believe your account has been accessed without your permission. We may suspend or close an account where we reasonably believe it has been used fraudulently, to abuse a promotion, or in breach of these Terms.
3. Products, descriptions and availability
We describe our products as accurately as we can, including materials, dimensions, care instructions and, where relevant, sizing guidance. Photographs are representative. Natural materials such as leather, rope, wood and stoneware vary in grain, tone and finish, and small variations between the item you receive and the photograph are normal and are not defects.
All products are offered subject to availability. Listing an item on the Site is an invitation to treat, not an offer to sell. We may change, limit or withdraw a product at any time before your order is accepted.
Our products are intended for animal use only. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Nothing on the Site is veterinary advice. If your animal is unwell, or you are unsure whether a product is suitable, please speak to a licensed veterinarian.
4. Sizing, suitability and safe use
Several of our products are sized against an animal’s measurements rather than its breed. Where a sizing method is given on a product page, please follow it. Toys, chews, crates, pens and grooming equipment must be used under appropriate supervision and in line with the guidance provided. No toy or chew is indestructible; inspect items regularly and withdraw anything that has become damaged, worn or small enough to be swallowed. We are not responsible for injury or damage arising from use that departs from the guidance supplied with a product.
5. Prices, taxes and pricing errors
All prices are shown in United States dollars and exclude shipping and applicable sales tax, which are calculated and displayed before you confirm your order. The price that applies to your order is the price displayed at the time your order is accepted.
We take care with pricing, but errors occasionally occur. Where a product is listed at an obviously incorrect price and the error is one you could reasonably have recognised as a mistake, we are not obliged to supply at that price. In that event we will contact you before dispatch and offer either to proceed at the correct price or to cancel the order with a full refund.
6. Orders and formation of contract
Submitting an order places an offer to buy. We will send an acknowledgement email confirming that we have received it; that acknowledgement is not acceptance. A contract is formed only when we send an email confirming dispatch, and it covers only the items named in that dispatch confirmation.
We may decline or cancel an order, in whole or in part, where the item is unavailable, where we identify a pricing or description error, where we cannot obtain payment authorisation, where we are unable to deliver to the address supplied, or where we reasonably suspect fraud or breach of these Terms. If we cancel an order you have paid for, we will refund you in full.
7. Payment
Payment is taken at the time your order is placed. We accept the payment methods shown at checkout. Card payments are processed by our payment provider under its own security standards; we do not receive or store your full card number, expiry date or security code. You warrant that the payment details you supply are complete and accurate.
If a payment is declined, reversed or charged back, we may suspend fulfilment of the order and, where an order has already shipped, seek recovery of the amount due together with any reasonable costs incurred.
8. Shipping, risk and title
Shipping timescales, carriers and costs are set out in our Shipping and Returns policy, which forms part of these Terms. Delivery estimates are estimates and not guarantees, and can be affected by carrier delays, weather and public holidays.
Risk in the goods passes to you on delivery to the address you supply. Title passes when we have received payment in full. Please check your order on arrival and tell us within a reasonable period if anything is missing, damaged or incorrect.
9. Returns, cancellation and refunds
Our returns process, the return window, the condition in which goods must be returned, and the items that are excluded from return for hygiene or safety reasons, are set out in full in our Shipping and Returns policy. Nothing in these Terms limits any right you may have under applicable consumer protection law.
10. Promotions, discount codes and gift items
Discount codes are issued subject to their own conditions, cannot be exchanged for cash, and may be limited by product, order value, customer, or time. Unless expressly stated, codes may not be combined. We may withdraw or amend a promotion at any time, and may cancel an order where a code has been obtained or used in a way we reasonably consider abusive.
11. Intellectual property
The Site, its content, product photography, copy, layout, logos and brand name are owned by or licensed to Goodies for Bio Co. and are protected by intellectual property law. You may view and print material for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape, or use our content or branding for commercial purposes without our prior written permission.
12. Acceptable use
You agree not to use the Site in any way that is unlawful or fraudulent, to attempt to gain unauthorised access to any part of the Site or its underlying systems, to introduce malicious code, to place speculative or automated orders, or to interfere with the operation of the Site or any other user’s use of it.
13. Third-party links
The Site may link to third-party websites or services that we do not control. We provide those links for convenience only. We are not responsible for the content, products or practices of any third-party site, and their inclusion does not imply endorsement.
14. Disclaimers and limitation of liability
We provide the Site on an “as available” basis and do not warrant that it will be uninterrupted or free from error. To the fullest extent permitted by law, we exclude implied warranties not expressly set out in these Terms.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for the goods giving rise to the claim, and we are not liable for indirect or consequential loss, loss of profit, or loss of opportunity.
15. Force majeure
We are not liable for delay in, or failure of, performance caused by events beyond our reasonable control, including carrier failure, severe weather, industrial action, interruption of utilities or communications, or acts of government.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes to our products, our operations, or the law. The version in force is the one published on this page at the time you place your order, and it is dated at the top. Continuing to use the Site after a change takes effect indicates your acceptance of the revised Terms.
17. Severability and waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of our right to enforce it later.
18. Governing law and jurisdiction
These Terms and any dispute arising out of them are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules. The state and federal courts located in New Jersey shall have exclusive jurisdiction, save that we may bring proceedings in the courts of the state in which you reside to recover sums due.
